The liability question for autonomous driving is still genuinely unsettled, and the legal frameworks being built now will shape the industry's risk calculus for decades. The manufacturer-as-defendant model (Tesla's approach to disavow responsibility for FSD misuse) and the operator-as-defendant model (Waymo commercial service) are heading toward a collision as more edge cases reach courts. The philosophical question I keep returning to: if a Level 4 system makes a statistically optimal decision that still results in harm, is that a product defect? Current product liability law wasn't designed for probabilistic decision systems. Has anyone seen a legal framework that handles this cleanly?
